1. Introduction

These terms govern your use of the Kiran website (kiran-web-ui.vercel.app) and the Kiran desktop application. By accessing or using our services, you agree to be bound by these terms and our general terms and conditions.

If you do not agree to these terms, please do not use our services.

2. General Terms & Conditions

Our services are subject to the NLdigital Terms (Nederland ICT Voorwaarden), which form the general terms and conditions of our agreement with you.

In the event of any conflict between these supplementary terms and the NLdigital Terms, the NLdigital Terms shall prevail unless explicitly stated otherwise below.

The NLdigital Terms have been deposited at the District Court Midden-Nederland, location Utrecht. The Dutch text of the NLdigital Terms takes precedence over any English translation.

3. Service Description

Kiran is a digital carbon footprint reduction platform that comprises:

• A desktop application for scanning and cleaning unnecessary files from your devices.
• A web portal for carbon impact tracking, analytics, and account management.
• A carbon calculator for estimating your digital environmental impact.

4. Subscription Plans

• Billing is handled securely via Stripe.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial billing periods.

5. Acceptable Use

When using Kiran, you agree not to:

• Reverse engineer, decompile, or disassemble the software.
• Use the service for any illegal purpose.
• Attempt to overload or disrupt our systems.
• Attempt to access other users' data.

6. Intellectual Property

• All intellectual property rights in the Kiran platform remain with Kiran, as set out in Article 10 of the NLdigital Terms.
• Users retain all rights to their own files. Kiran never claims ownership of user files.
• Kiran's scanning process only reads file metadata — never file contents.

7. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

8. Limitation of Liability

• Liability is limited as set out in Article 16 of the NLdigital Terms.
• The service is provided “as is” without warranties of any kind, express or implied.
• Kiran is not liable for any data loss resulting from cleanup actions confirmed by the user.
• As a safety measure, files are moved to the recycle bin rather than permanently deleted.

9. Termination

• You may terminate your account at any time through your account settings.
• We may suspend or terminate accounts that violate these terms.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Governing Law & Disputes

These terms are governed by the laws of the Netherlands, as set out in Article 22 of the NLdigital Terms. Any disputes arising from or in connection with these terms will be resolved in accordance with the dispute resolution provisions of the NLdigital Terms.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
